15 violations; 4B’s Tavern, formerly Four Brothers, in York, fails restaurant inspection, Person in Charge does not have adequate knowledge of food safety

4 B’s Tavern formerly known as Four Brothers Restaurant and Tavern

The Pennsylvania Department of Agriculture’s Bureau of Food Safety and Laboratory Services conducted an unannounced retail food inspection on October 8, 2019. As a result of that inspection, and due to the severity of the specific violations the 4B’s Tavern formerly known as Four Brothers Restaurant and Tavern  was cited as being, “Out of Compliance” with Pennsylvania’s food safety regulations. During this inspection a total of 15 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • The Person in Charge does not have adequate knowledge of food safety in this food facility as evidenced by this non-compliant inspection.
  • The Person in Charge did not demonstrate adequate knowledge of the PA Food Code as evidenced by incorrect responses to food safety questions related to dish sanitizing.
  • Working containers of multi surface orange cleaner and grill cleaner were stored on the same shelf with equipment in the kitchen area.
  • Upper interior of microwave and can opener cutting blade, food contact surfaces, observed to have food residue and are not clean to sight and touch.
  • Observed insecticides (Ortho Home Defense in the bar area, not labeled by the manufacturer as approved for use in a food facility.
  • Soufflé cup used as a dispensing utensil observed in container of breading. (results in hands touching food)
  • Wood legs supporting dish machine drainboard, in the kitchen area, are not smooth, non-absorbent, corrosion resistant.
  • Chlorine chemical sanitizer residual detected in the final sanitizer rinse cycle of the low temperature sanitizing dishwasher was 0 ppm, and not 50-100 ppm as required. (not sanitizing)
  • Non-food contact surfaces of hood ventilation system not cleaned at a frequency to preclude accumulation of dirt, grease and soil.
  • Floor in the kitchen area, is made of painted concrete, paint is chipping, floor is rough and is not durable, smooth, non-porous, non-absorbent.
  • Floor in the bar area is made of tile and is cracked / tiles are missing and is not a smooth, easily cleanable surface.
  • Door to the outside, located in the kitchen/back area of the food facility is being propped open. (risk of allowing access to insects and rodents)
  • Observed wet wiping cloths in kitchen area, not being stored in sanitizer solution.
  • Women’s toilet room is not provided with a covered waste receptacle for sanitary napkins.
  • Observed dish storage shelving equipment, directly to the left of flat grill, with an accumulation of dust, dirt, food residue, debris on non-food contact surfaces.
  • Plumbing system not maintained in good repair – observed faucet leaking at the two basin sink.

There are over 26,000 eating and drinking establishments in Pennsylvania, and thousands more convenience stores,  grocery stores and schools required to be inspected by the Department of Agriculture and, in some cases, local government entities at least once a year. Out of more than 2,000 inspections each month only about 150 are found to be, “Out of Compliance.”

Violations leading to the Out of Compliance designation are more critical violations. Establishments can score a number of lower level violations without achieving the Out of Compliance designation.
